Terms of use.
Introduction
These terms explain the rules for using NV Play's websites. Please read them before you use our Sites. By using any of our Sites, you accept these terms. If you don't accept them, please don't use our Sites.
Our Sites are operated by NV Play Limited, a company registered in New Zealand (company number 6612116). In these terms, "we", "us" and "our" mean NV Play Limited, and "you" means anyone who uses our Sites.
The Sites these terms cover
These terms apply to the following websites, which we call "our Sites":
- nvplay.com, our main website
- live.nvplay.com, where we publish live cricket scores and live streams on behalf of our customers
- support.nvplay.com, our support centre and knowledgebase
They also apply to any other NV Play website or subdomain that links to these terms. Some sections below apply only to a particular Site, and we say so where that is the case.
What these terms do not cover
These terms are about using our websites. They don't govern your use of NV Play software or services. If you're a customer, for example a club, league, school or association, your use of our software and services is set out in our End User Licence Agreement and any agreement you have signed with us. If those documents conflict with these terms, those documents apply to the software and services.
How we handle personal information is explained in our Privacy Policy. How we use cookies is explained in that policy and managed through the cookie consent tool on our Sites.
Using our Sites
You may use our Sites for your own personal, non-commercial use, and to contact us or make genuine enquiries through our forms.
You agree not to:
- copy, scrape, harvest or extract content or data from our Sites using automated tools or otherwise, beyond normal personal viewing;
- use our Sites in any way that breaks the law or infringes someone else's rights;
- try to gain unauthorised access to our Sites, our servers, or any system connected to them;
- introduce viruses, malware or any other harmful material;
- interfere with how our Sites work, or place an unreasonable load on them;
- submit false information through our forms, or use them to send spam or unlawful content.
We may suspend or withdraw your access to any of our Sites if you break these terms.
Live scores
This section applies to live.nvplay.com.
We publish live cricket scores and match data on behalf of our customers. The scores are entered in real time by scorers at the ground or by our customers' systems. We pass that information on, but we don't create it or check it.
Because of this, we can't promise that live scores are accurate, complete, up to date or always available. Scores may contain errors, be delayed, or be interrupted, and matches may be rescheduled or abandoned without notice.
Live scores are provided for general information and enjoyment only. You must not rely on them for betting, gambling, or any financial or other important decision. We are not responsible for any loss you suffer if you do.
The scores and match data on live.nvplay.com belong to us or to our customers. You may view them for your own personal use, but you may not copy, scrape, republish or extract them, or build a product or service on top of them, without our written permission.
Help centre
This section applies to support.nvplay.com.
Our help centre is provided through a third-party platform. When you use it, that provider processes some of your information on our behalf so we can give you support. We explain how we handle your information in our Privacy Policy.
When you contact us or post through the help centre, please give accurate information and don't submit anything unlawful, offensive, or that infringes someone else's rights. We may use what you send us to answer your query and to improve our support.
Advertising
Some of our Sites, including live.nvplay.com, may carry advertising and sponsored content.
Our advertising is contextual. We choose ads based on the content of the page being viewed, not by tracking your activity to target ads at you. We don't use behavioural or targeted advertising on our Sites.
We do use analytics and marketing technologies for other purposes, such as understanding how our Sites are used and measuring our own marketing. These are not used to serve you behavioural advertising, and our Privacy Policy explains what they collect and how you can control them.
We'll make it clear when something is an advertisement or is sponsored. Adverts are the responsibility of the advertiser, not us. We don't endorse advertised products or services, and any dealings you have with an advertiser are between you and them.
We use a cookie consent tool to manage cookies across our Sites. Any non-essential cookies, including any used in connection with advertising, analytics or marketing, are set only in line with the choices you make there. You can change your choices at any time. Our Privacy Policy explains this in more detail.
Our content and trade marks
We own our Sites and everything on them, including text, images, logos, design and the "NV Play" name and marks, or we use them under licence. They're protected by copyright, trade mark and other laws.
You may view and use our Sites for your own personal, non-commercial use. We don't grant you any other rights. In particular, you may not copy, reproduce, republish or use our content or marks for any commercial purpose without our written permission.
Links to other websites
Our Sites may link to websites we don't control. We provide those links for convenience only. We're not responsible for the content of other websites, and a link doesn't mean we endorse them. Using a linked site is at your own risk.
Availability of our Sites
We try to keep our Sites available, but we can't promise they will always be available or free of faults. We may change, suspend or withdraw all or part of any Site at any time, and we won't always be able to give you notice.
Our responsibility to you
Nothing in these terms limits or excludes our responsibility where the law doesn't allow it. This includes responsibility for death or personal injury caused by our negligence, for fraud, and for any of your rights under consumer law that can't be excluded.
Subject to that, our Sites are provided "as is". As far as the law allows, we're not responsible for any loss or damage that was not a foreseeable result of us breaking these terms, or that arises from your use of, or inability to use, our Sites, or from your reliance on any content on them, including live scores.
If you're a consumer, you have legal rights that these terms don't affect.
Changes to these terms
We may update these terms from time to time, for example to reflect changes to our Sites or the law. We'll post the current version here with the date it took effect. If we make a significant change, we'll give you reasonable notice. By continuing to use our Sites after a change, you accept the updated terms.
Which law applies to you
These terms are governed by the law of New Zealand. If a dispute arises, you and we agree that the courts of New Zealand have non-exclusive jurisdiction.
If you're a consumer living outside New Zealand, you still have the protection of any consumer laws that apply where you live, and you may be able to bring a claim in your own country's courts. Nothing in these terms takes those rights away.
