Scope of this policy
This Privacy Policy explains how we handle personal information when NV Play acts as a data controller; for example in relation to nvplay.com, our marketing, trials and product analytics. When our customers (such as clubs, leagues or other organisations) use our software and services and we process personal data on their behalf, we usually act as a data processor and that processing is governed by our agreements with those customers (including our Data Processing Agreement), as well as this Privacy Policy where relevant.
Who are we?
Our websites and related software is operated by NV Play Limited, a company registered in New Zealand (Company Number: 6612116). NV Play Limited is the data controller for our websites and for certain processing activities related to our software and services, as described in this Privacy Policy.
What information do we collect?
Log data
When you visit our websites or use our software, our servers may automatically log the standard data provided by your web browser or internet provider. It may include your computer’s Internet Protocol (IP) address, your browser type and version, the pages you visit, the time and date of your visit, the time spent on each page, and other details. We will treat this information as personal information.

- to enable us to provide you the full benefit of our website or software as we have contracted to;
- to enable you to customise or personalise your experience of our website or software;
- to enable you to access and use our website, associated applications and associated social media platforms;
- for account setup and administration;
- to contact and communicate with you;
- for internal research and development purposes;
- for data aggregation and statistical modelling;
- for internal record keeping and administrative purposes;
- for analytics, market research and business development, including to operate and improve our website, associated applications and associated social media platforms;
- for advertising and marketing, including to send you promotional information about our products and services that you have explicitly opted into receiving; and
- to comply with our legal obligations and resolve any disputes that we may have.
Where we use AI-enabled or automated tools, we do so in line with applicable privacy laws and this Privacy Policy. We do not use personal information to train third-party AI models for those providers’ own purposes unless we have told you and have a lawful basis to do so.
What legal basis do we have for processing your personal data?
We will process your personal information lawfully, fairly and in a transparent manner, in line with applicable data protection laws (for example, the EU General Data Protection Regulation (GDPR), UK GDPR and other similar laws where they apply).
We collect and process information about you only where we have legal bases for doing so. These legal bases depend on the services you use and how you use them, meaning we collect and use your information only where:
- it's necessary to perform a contract to which you are a party, or to take steps at your request before entering into a contract (for example when we provide a service you request);
- it satisfies a legitimate interest that is not overridden by your data protection interests, such as research and development, marketing and promoting our services, and protecting our legal rights;
- you give us consent for a specific purpose (for example consenting to our newsletter); or
- we need to process your data to comply with a legal obligation.
Where you consent to our use of information for a specific purpose, you can change your mind at any time, although this won't affect any processing that has already taken place.
When do we share personal data?
In relation to any personal information we may collect during your use of this website, we:
- will not disclose personal information we collect from you through our website other than as set out in this privacy policy or as otherwise agreed with you;
- may disclose information about you to our employees, contractors and affiliates for the purposes set out above;
- may disclose information about you to our contractors and suppliers so they can provide services to us, including transaction processing, hosting, partnering, marketing and support services;
- may, if ownership of all or part of NV Play Limited changes, transfer your information to the new owner so our websites can continue operating, with our obligations under this policy passing to them; and
- reserve the right to disclose your personal information where appropriate to comply with the law, respond to a lawful request, or protect our rights.
Information collected through our websites that does not identify users is owned by us and may be disclosed by us. We may share aggregated information about our users with our customers, affiliates, partners and advertisers.
We use Google Analytics to help us understand how visitors use our websites and software. Google processes this usage information on our behalf and explains its practices in Google's privacy policy at https://policies.google.com/privacy. Other analytics and advertising providers we use are listed in our cookie consent tool.
Where do we store and process personal data?
The personal information we collect is stored and processed in New Zealand, Australia, the United Kingdom and/or the United States, or wherever we or our partners, affiliates and third-party providers maintain facilities. By providing us with your personal information, you consent to its disclosure to these overseas third parties.
We will ensure that any transfer of personal information from the European Economic Area (EEA) and/or the United Kingdom to countries outside those areas is protected by appropriate safeguards, for example data protection clauses approved by the European Commission or the UK authorities, or other legally accepted transfer mechanisms (such as Standard Contractual Clauses and the UK international data transfer addendum).
Where we transfer personal information from a non-EEA country to another country, you acknowledge that third parties in other jurisdictions may not be subject to similar data protection laws. There are risks if any such third party acts in a way that would breach the data privacy laws in our jurisdiction, which might mean you can't seek redress under those laws.
How do we secure personal data?
We use best-practice technical and organisational security measures to protect the personal information we store against accidental or intentional manipulation, loss, destruction and unauthorised access. Our security procedures are continually enhanced as new technology becomes available.
How long do we keep your personal data for?
We don't keep personal information for longer than is necessary for the purposes for which it was collected, or for any period we're required to keep it to comply with our legal and regulatory obligations.
While we retain this information, we protect it within commercially acceptable means to prevent loss, theft, and unauthorised access, disclosure, copying, use or modification. That said, no method of electronic transmission or storage is completely secure, and we can't guarantee absolute data security.

If you are under 16, you must have your parent or guardian's permission to access and use our websites, and they must have consented to you providing us with your personal information. If you ask us to restrict how we process your information, we'll let you know how that affects your use of our websites, products and services.

You may request details of the personal information we hold about you, and a copy of it. Where possible, we'll provide this in CSV or another easily readable machine format. You may ask us to erase the information we hold about you at any time, and you may ask us to transfer it to another third party. In each case, we'll let you know how the request affects your use of our websites, products and services.

If you believe any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us. We'll take reasonable steps to correct it.
Notification of data breaches
We will comply with the laws that apply to us in respect of any data breach.
Complaints
If you believe we have breached a relevant data protection law and wish to complain, please contact us with full details of the alleged breach. We'll investigate promptly and respond in writing, setting out the outcome and the steps we'll take. You also have the right to contact a regulatory body or data protection authority about your complaint.
Unsubscribe
To unsubscribe from our email database or opt out of communications (including marketing), please contact us or use the opt-out facilities provided in the communication.
AI and automated analysis
Some NV Play features and internal business tools may use artificial intelligence, machine learning or automated analysis to help deliver, support, secure and improve our services.
This may include tools that help with scoring, video analysis, highlights, performance insights, product analytics, customer support, software development, security monitoring and internal administration.
Depending on how you use NV Play, these tools may process account information, usage data, match data, player and team data, video or photographic footage, device information, support requests and other information described in this policy.
We use AI and automated analysis only where we have a lawful basis to do so, such as providing our services, performing a contract, pursuing legitimate business interests, complying with the law, or relying on consent where consent is required.
We may use aggregated, de-identified or pseudonymised data to develop, test and improve our services, including AI-enabled features. We do not use personal information to train publicly available third-party AI models unless we have told you and have an appropriate lawful basis.
We use trusted service providers to support some AI-enabled features and internal tools. Where those providers process personal information for us, we use contractual, technical and organisational safeguards to protect it and limit how it can be used.
AI-generated outputs are intended to support human users, not replace their judgement. We do not use fully automated decision-making that produces legal or similarly significant effects about individuals without appropriate safeguards and human review.
Automated decision-making and profiling
NV Play uses automated systems, analytics and AI-enabled tools to generate insights, reports, recommendations and operational outputs. These are designed to support human users and improve the services.
We do not use solely automated decision-making that produces legal or similarly significant effects about individuals, unless we have a lawful basis to do so and have appropriate safeguards in place.
If we introduce a feature that makes or materially contributes to such a decision, we will provide clear information about the feature, the personal information used, the likely effects, and any rights to request human review, challenge the decision, or object where applicable.
Children
Our websites, including our live scores, may be viewed by people of all ages, including children, for example at school and junior cricket. Our advertising is contextual, so we don't use tracking to target ads at anyone, including children, and we don't knowingly build advertising profiles of children. The analytics and marketing technologies described above are optional and only used with consent.
If you are under 16, please get your parent or guardian's permission before giving us personal information. If you believe a child has given us personal information that we shouldn't hold, please contact us and we'll remove it.
Linking to other websites or third-party content
Our websites or software may link to other websites or applications. These are not endorsed by us unless explicitly stated, may operate independently, and may have their own privacy notices, which we strongly suggest you review. If a linked website is not owned or controlled by us, we are not responsible for its content or the privacy practices of its operator.
Business transfers
If we or our assets are acquired, or in the unlikely event that we go out of business or enter bankruptcy, we would include data among the assets transferred to any parties who acquire us. You acknowledge that such transfers may occur, and that any parties who acquire us may continue to use your personal information in line with this policy.
Changes to this policy
We may change this policy from time to time to reflect current practices or changes in the law. We'll take reasonable steps to let users know about changes via our websites. Your continued use of our sites after any change will be regarded as acceptance of our privacy practices.
If we make a significant change to this policy, for example changing a lawful basis on which we process your personal information, we will ask you to re-consent to the amended policy.
